These Terms & Conditions apply to the purchase and use of website services provided by Nunkio (“we”, “us” or “our”). By purchasing a website package, you (“the Client”) agree to the terms set out below.
1. The Service
Nunkio provides a one-page WordPress website based on a selection of pre-designed templates. The Client selects a template, which is customised using the Client’s supplied logo, colours, fonts, images, written content and other relevant business information.
The annual website package may include:
- One-page WordPress website
- Website template customisation
- Appointment and/or class, workshop and event booking functionality
- Domain name registration or renewal
- Website hosting
- WordPress and plugin updates
- General technical maintenance
- Listing in the Nunkio online directory
The exact functionality included will depend on the package or services purchased by the Client.
2. Template-Based Website Design
The website is a template-based product and is not a fully custom website design.
Customisation is limited to the options and functionality available within the selected template and package. This may include changes to colours, fonts, images, logos and supplied content.
Requests for additional pages, custom functionality, significant layout changes, integrations or other work outside the standard package may incur additional charges. Any additional charges will be communicated to the Client before the additional work is undertaken.
3. Client Content
The Client is responsible for supplying all information and content required to complete the website, including logos, photographs, written content, pricing, service information, contact details and booking information.
The Client confirms that they own, or have permission to use, all content supplied to Nunkio.
Nunkio is not responsible for copyright, trademark, privacy or other legal claims resulting from content supplied by the Client.
4. Website Approval
The Client is responsible for reviewing their website and checking that all information, pricing, contact details, booking settings and other content are correct before the website is approved for launch.
Once the website has been approved by the Client, any substantial changes may be treated as additional work and charged separately.
5. Plans and Fees
The website service is provided on an annual plan or a monthly plan.
The annual fee covers the services specified in the Client’s package for a period of 12 months. The annual service period begins on the date specified when the website package is purchased or activated.
The monthly plan is billed monthly and has a minimum term of 3 months from the first payment. After that it continues month to month until the Client cancels. If the Client cancels within the first 3 months, the remaining months of the minimum term are still due.
All plans and monthly extras are billed in advance.
Additional work or services requested outside the package are not included in the plan fee and may be quoted and charged separately.
6. Pricing and Currency
Clients in South Africa see and pay prices in South African Rand (ZAR). Clients in other countries see fixed prices in US dollars (USD), British pounds (GBP) or euros (EUR). The prices that apply are based on the Client’s location, and at checkout on the Client’s billing country.
All payments are processed by Payfast in Rand. For Clients outside South Africa, the Rand amount charged is the equivalent of the fixed foreign price at the exchange rate on the day of payment. Monthly and annual renewals are charged the same way, at the exchange rate on the renewal date.
The Client’s bank or card provider may apply its own exchange rate or fees, so the amount on the Client’s statement may differ slightly from the price shown.
All prices are final. No VAT is added.
7. Annual Renewal
The website package is renewable annually.
A renewal notification will be sent to the Client 30 days before the next annual payment is due.
The renewal will be charged at the applicable annual rate at the time of renewal. The renewal price may differ from the Client’s original purchase price, including where an introductory or promotional price applied to the first year.
Nunkio will give the Client at least 30 days’ notice before any change to their plan price.
8. Cancellation
The Client may choose not to renew the website service for another year.
If the Client does not wish to renew, cancellation must be requested before the annual renewal payment is processed.
Cancellation prevents the service from renewing for the following annual period. It does not terminate or refund the current annual service period.
The Client will continue to have access to the services included in their package until the end of the period that has already been paid for.
Monthly plans may be cancelled at any time after the 3-month minimum term and continue until the end of the month already paid for. If a monthly plan is cancelled within the minimum term, the remaining months of the minimum term are still due.
9. Refund Policy
Plan payments are non-refundable.
Because the service includes the allocation of hosting resources, domain-related costs, software and plugin costs, website setup, customisation and development time, plan payments are not refunded once payment has been made.
Once-off extras (pages, blog, account setup session, domain transfer) are paid before the work starts and are non-refundable once the work has been done.
This includes, but is not limited to:
- Clients who change their mind after purchasing
- Clients who decide they no longer require a website
- Clients who fail to provide the information or content required to complete the website
- Clients who do not make use of the website or booking functionality
- Clients who cancel during a paid annual period
- Unused portions of an annual subscription
- Domain, hosting or third-party costs already incurred on behalf of the Client
Where applicable consumer law provides the Client with rights that cannot legally be excluded, those rights will continue to apply.
10. Failed or Missed Payments
If a payment fails, Nunkio will let the Client know and try again automatically over the next 7 days. The Client can also pay at any time from My Account. If it still hasn’t been paid after 7 days, the website, hosting, booking functionality and associated services may be paused until the account is up to date.
If the account remains unpaid, the website and associated data may eventually be removed from our servers.
Nunkio is not responsible for loss of website content or data resulting from a Client allowing their service to expire.
11. Domain Names
Where a domain name is included in the package, Nunkio may register and manage the domain on behalf of the Client.
Domain availability cannot be guaranteed until registration has been successfully completed.
If the Client cancels or does not renew the service, responsibility for any future domain renewal costs transfers to the Client if they wish to retain the domain.
Any domain transfer requested by the Client may be subject to applicable registrar requirements, transfer procedures and outstanding account balances.
12. Hosting and Maintenance
Hosting and routine WordPress and plugin updates are included for the duration of the Client’s active annual package.
While reasonable steps are taken to maintain website availability, uninterrupted or error-free operation cannot be guaranteed. Temporary downtime may occur as a result of maintenance, server issues, software updates, third-party services or circumstances outside our reasonable control.
13. Third-Party Services
The website may use third-party software and services, including WordPress plugins, booking systems, payment gateways, email services, WhatsApp services, social media integrations and other external platforms.
Nunkio is not responsible for interruptions, changes, errors, pricing changes or discontinuation of services provided by third parties.
Any transaction fees, messaging fees, payment gateway charges or other third-party charges that are not expressly stated as being included in the website package remain the responsibility of the Client.
14. Booking Information
The Client is responsible for ensuring that their services, prices, schedules, appointment availability, cancellation rules and other booking information are accurate.
Nunkio provides the technical functionality that allows bookings to be made but is not a party to any booking, transaction or agreement between the Client and their customers.
The Client remains responsible for managing their customers, appointments, cancellations, refunds and disputes.
15. Directory Listing
Where included, the Client’s business may be listed in the Nunkio online directory at no additional charge.
The directory listing is a separate promotional benefit and does not guarantee enquiries, bookings, website traffic, search engine rankings or business results.
Nunkio reserves the right to manage the structure, categories, functionality and presentation of the directory.
16. Website Ownership and Transfer
The Client retains ownership of the logos, images, written content and other original materials they supply.
The website may incorporate templates, plugins, software, licences and other components owned or licensed by Nunkio or third parties. Ownership of these components does not transfer to the Client.
If the Client wishes to move their website to another hosting provider, any transfer will be subject to the technical feasibility of transferring the website and the licensing terms applicable to the software and plugins used.
17. Limitation of Liability
Nunkio will take reasonable care in providing and maintaining the website service but cannot guarantee that the website will generate bookings, enquiries, revenue, traffic or any particular business result.
To the extent permitted by law, Nunkio will not be liable for indirect or consequential losses arising from the use or inability to use the website, booking functionality, hosting or third-party services.
18. Changes to the Service or Terms
Nunkio may update these Terms & Conditions from time to time to reflect changes to the service, pricing, technology, third-party services or legal requirements.
The Terms & Conditions applicable to the Client will be those published or otherwise provided at the relevant time, subject to any rights the Client may have under applicable law.
19. Contact and Cancellation Requests
Questions regarding these Terms & Conditions or requests to cancel an upcoming renewal should be submitted to Nunkio using the contact details provided on the Nunkio website.
